new sign at crystals ac that says unprotected beach no swimming. on noreaster someone from the highrise building called the cops (who does that?) bc my friend and i were out surfing there. the cop basically said sign says that i gotta do what i gotta do maybe you could go somewhere else insinuating he was going to do anything if we moved. rips were retarded so it made sense to surf there bc it was safe so i tried asking more about the law behind it but he got defensive and pushed more for just go south more issue over. i thought we were outside the "swimmers" closer to like water craft and dont fall under that am i right? if not im gonna talk to someone in the city because ive been surfing there for years and its a "surfing beach" it should be at your own risk. can someone provide with me any insight into the actual laws governing that or with the actual laws i can print out and kindly tell the cop to piss off. i know hes doing his job but i think someone is misinterpreting something whether me, and all the others who surf crystals, or him. no answers by tomorrow ill call the city i guess
Why not just stay out there look towards the horizon and ignore him..He wont get his underwear wet to come say something to you and you can just say you could'nt hear him over the loud wave break duhhh
ok, so far all great suggestions. Really helpful. They should all really help my situation. Maybe I could say well that depends on yer definition of swimming too. I almost got arrested on the sunday pre sandy there(def more warranted w state of emergency) so I don't want to press my luck but does anyone know the real rules governing surfing it seems a grey area and I'd hate to do more harm than good by pressing them to be more clear cut if it means us losing rather than gaining
I dont know much about laws except that it's fun to break them when you can, so this prolly won't help much, but if the sign says 'unprotected beach' tell him you weren't on the beach. How far out into the ocean do they think their bs authority extends?
Can you imagine if they tried that crap in Cali? There'd be a riot. Can't go in a public ocean. Give me a break. Swimming or surfing. It's a PUBLIC OCEAN. Swim/surf at your own risk.
exactly what this guy said.surf or swim at ur own risk.its the ocean,how can they charge people to go in the sea??!!!!its not like that in cali.i do respect the bennies who arent ocean friendly to have a lifegaurd present so the bennies dont die,pay for it all day,but for the rest of us surfers who are in the ocean during noreasters in december shouldnt have to deal with the nonsense
The only reason they blackball beaches during the summer is to keep bathers safe, and bathers are entitled to bathe. But during the off season, all public beaches are still public... to fishermen, swimmers, surfers, kayakers, SUPers, whatever... unless there's a public health risk. Depending on the municipality, that definition of risk may include big surf, in addition to pollution or other water hazards like debris. You have to check with the municipality. Sometimes showing up at a town meeting with a crowd of guys to line up at the mic during the open public comment portion of the meeting can get the point across. Other than that, access across private property is usually the issue... at least around here.
