Every time I start thinking that, the modicum of wisdom I have gained as I've gotten older kicks in. It's just like metard said: Lawsuit. There have been a number of occasions where I have really wanted to paddle over and literally slap the $h!t out of some asshat that's acting the fool, repeatedly dropping in, etc. However, I have realized that while I may be able to physically get away with it at 6 ft tall 190lbs, that isn't going to do a damn thing come time when he (or his daddy) sues my ass for assault and battery. And in this day and age, that's more likely than not going to be the end result.
I agree but if you (literally) slap someone, they really dont have any means for a lawsuit unless there is physical damage. Sure you can get arrested but is someone really going to go through the trouble over a slap?
I feel like a new tactic of the pussified populace is to lure you into a fight so they could film it and then have you arrested...happened to me a couple times, including tuesday night by like 5 kooks who were trying to vibe me as I was changing in the lot...it was dark and the beach folks had left and the bar rats had emerged. I wanted to crush them.

Fitz, you're correct. However, I think CDsurf was attempting to ask if you think someone is really going to go to all the tortured legal trouble over a minor incident of battery. And my response is yes. I think in today's litigious & (to borrow from seldom) pussified culture, the moment someone gets smacked, they will run and get the authorities. And, it's doubly scarey when you think that some punk might film it and creatively edit the footage to make you look like the instigator/bully, and the other guy a choirboy.
What if you paddled out with a gopro and a supersoaker filled with baby oil and coated a few kooks and their boards with slippery goo? Is that assault, or just good ole fashioned fun? Dune, mabye he heard GO GO GO! instead of NO NO NO! It happens to me all the time when I drop in on someone. "Dude, I swear to god, I thought you said GO!" (This actually did happen once, and the guy almost was ready to fight me, and laughed when I told him what I thought I heard - we are both locals and it happened at the reef). We all screw up sometimes. Own it. Don't be crying in the impact zone. No one can hear you scream from the Impact Zone. (Que the Twilight Zone music).
I think its smart to weigh all the possible repercussions of your actions. But, in my humble opinion the pros outweigh the cons of me taking that action if someone (repeatedly) shows me disrespect. ie, i will sleep better at night. I still think though that most of the time if someone is aware that they have initiated the confrontation, that they wont follow through with a silly lawsuit for simple assault. Exceptions to every rule though.
putting your hands on someone is a dangerous game. what if your aim is off just a bit and your slap land on his ear.... and pow he's got a broken eardrum... you will be sued out your ahole. What if the guy has braced on his teeth.... cutting up the insides of his gums??? you never know.. Also the other issue is, lots of tuff talk comes from behind a keyboard. when in the live action, can be a lot different. Mr.disrespectful might have 8 or 9 pals sitting up on the beach and next thing you know you've got a welcoming party waiting for you when paddle back in. But on the flip side, when I executed the fitzpedo on some 19 year old guy I took a risk by launching myself at him when he dropped in on me. but that was a move that could have been seen as an unavoidable collision created by the dbag that dropped in on me if he were to try and sue me.

Fitzpedo, lol. Im not disagreeing with you on your points. It all comes down to each situation since every one is unique. There are always what ifs, thats just a chance you take for standing up for yourself. I dont go around trying to act tough though or go around looking for trouble so i dont have a problem.
