By that logic all judicial decrees are opinion. The SCOTUS upheld the "advise and consent" clause.

If it is just an opinion then I am sure you can show precedent of the POTUS replacing an AG without nomination.

Even though he cut and past the op-ed (I was hoping Kyle was aware of this without googling the NYT for an answer), I think the opinion is probably valid.

Advise and consent is there for a reason. With control of the Senate, there should not be an issue with this and for the “appointed” AG, that process will ensue.

I think Trump is well aware of what he was doing by naming him as the “working AG”. I believe it is posturing around the Mueller investigation. And to get folks on the left to hyperventilate lol...there was no way he was going to appoint Rosenstein.

I haven’t seen a cogent argument that appointment falls within constitution.

 

Well ignoring the Constitution to rile up the left is a pretty sad statement about our current political situation. Not exactly what our Founding Fathers had in mind.

Why don't you like Trump? Is it the record growth? Record unemployment? Killing the TPP? Pulling out of the carbon taxes? Loosening of regulations that has seen entrepreneurship grow rapidly? It’s not so much the cutting and pasting...it’s the flow of information to the populace and how said populace takes opinion and processes it.

Founding fathers put together a pretty solid document. Not sure who is most guilty for ignoring it. But, Trump’s appointment of an “acting” AG without advise and consent is not the most blantant attempt to ignore...

He is just pushing back on the liberal left. Honestly, I can’t blame him. His issues/style aside, he has gotten hammered (including the Mueller probe, which I tend to believe is fruitless). the dems are actually more guilty in what ensued after Hillary lost IMO...they were shocked and went nuclear.

It’s a shitshow. What would you do in his position for interim AG? Sure As hell would not appoint rosenstein. He could have certainly appointed someone that has been through advise and consent but under the circumstances, I think he did what made the most sense...for the interim period.

I gotta admit Trump's strategy of not asking for permission and never begging for forgiveness has made him POTUS so why would he change his tune now? The Dems way over reacted during the Cavanaugh hearings and are no longer the adults in the room. The next two years will be a reality show gone off the rails. Jerzy Shore meets Survivor.

I am not a Constitutional expert nor a lawyer. So when it is outlined in a logical fashion and without precedent by someone with more experience in the field, I think it is a fair criticism. I then did my own digging afterwards and could not find anything to suggest otherwise.

If you say it is fair game, tit for tat, then again we the people are the ones that suffer. The bar of what we willing accept for representation gets lower and lower. Democrats are guilty of lowering the bar also, don't get me wrong. But continued defiance of the Constitution by the POTUS will come back to bite the Repubs in the ass when a Liberal takes office. And then we all suffer some more.

The shitshow is of his own making. He pushed Sessions out. Usually if know you're going to fire someone in a valuable position, you try to have their replacement lined up. If not Rosenstein, then have someone else ready to confirm. Not like McConnell is going to do anything but get the guy confirmed. Just poor planning and execution all around.
