I'll be in Hatteras in August. I'll take a drive up there and roll around in the sack with this Donna lady for a night or two. After she's had some of the Chavez sausage, she'll change her tune. Beach access for all!

 

Bob Hovey (The guy arrested) I have known for 30+ years, such a nice guy & also the owner of DVO surf shops in Duck & Salvo. I am pretty sure that the lady was from Ohio. Bob has been dealing with this for years but last & this year even more.

It's BS that these people think because they have money they own everything around & make the rules.

 

Seriously, it's a beach in Duck NC. It's not OCNJ or Va Beach. What does this crinkled up old hoar think is gonna happen? So a few surfers and/or fisherman use the beach there? She needs to be tied to post, dipped in sugar, and placed on top of a fire ant mound.

I think Duck is the most overrated town on the NC coast. Why anybody would drive all the way here and vacation anywhere north of the Bonner Bridge (or whatever they're calling it now) makes zero sense to me. I was up there on Memorial Day for that long period swell and surfed a good sandbar in Salvo and literally had it all to myself. So much for good ole southern hospitality. Nobody retires and moves north and here's video proof of why. Yankee douche canoes!!

 

Nothing and I mean nothing fires up the south then those from the North coming down and doing such things. If he was a good ol boy that would have ended in those 2 on the pavement.

 

Because our tax dollars goes to their beach nourishment.

Not actually so in most states with oceanfront beaches in this great nation...in most states, the guvmint owns the sand below the mean high tide line...

Wouldn't it be socialist for the govt(s) to arbitrarily decide that it owns certain pieces of land 'for the public good?'

In Massachusetts, private coastal property owners own the beach area adjacent to their properties down to the mean low tide area.

The origin of this law dates back to the Mayflower days. In order to facilitate coastal development, under the Colonial Ordinances of 1641-47, the Massachusetts Bay Colony conveyed most, but not all, rights of ownership to the area between the average or mean high water mark and the low water mark (up to 100 “rods,” or 1,650 feet, from the high water mark) to all private coastal landowners. The land—but not the water—between the two tide marks is known as “private tidelands.” This typically includes all of the wet sand area on beaches.

The general rule is that with some limited exceptions explained below, beach-goers in Massachusetts cannot access any private beach area down to the low tide water mark without the permission of the beachfront property owner.

And so there's your legal precedent. America being a land of laws, not enraged beavers (used to be that way, anyways), beaches can be private land.

For what it's worth, the Town of Duck's website says this:

STATEMENT REGARDING TOWN OF DUCK BEACH ACCESS, MAY 29, 2019


On Wednesday, May 29, at approximately 8:00 a.m., Mr. Robert E. Hovey was taken into custody and charged with second-degree trespass (N.C.G.S. Section 14-159.13) in the location of Seabreeze Drive. This charge is comprised of the following: Without permission, entering or remaining on someone else’s property after being notified not to enter or remain there by the owner, a lawful occupant, or other authorized person; or where there is a notice posted informing intruders not to enter the property.

The beach access located at the end of Seabreeze Drive is a private access owned and maintained by the Sand Dollar Shores HOA. The charge and arrest were the culmination of a long-standing dispute between Mr. Hovey and the property owners of the Sand Dollar Shores subdivision. After repeated attempts by the Town of Duck Police Department to pursue a peaceful resolution, officers on the scene today acted to diffuse a situation that was escalating.

To be clear, in accordance with the North Carolina public trust and state statutes, the beaches in Duck are public. The Town of Duck does not restrict an individual’s use of the public beach, but it does not own or maintain any beach access locations in the town. Because the accesses are privately owned and maintained, the Town cannot grant permission for their use and unauthorized use could be deemed trespass as it would with any other private property. The Town does not monitor any beach access locations with the intent to discern between authorized and unauthorized users of a private beach access. The Town will respond to complaints of use by unauthorized individuals and these are handled in conformity with other simple trespass complaints.

Beach access locations in Duck, whether on easements or individual property parcels, are available to Duck residents, renters, and their guests through private accesses maintained by neighborhood homeowners’ associations (HOA). These accesses are not available to the general public as they are not owned or maintained by the Town of Duck.

Access has always been an issue in duck/Corolla. We used to sneak any way we could to surf up there including research pier. bob’s crusade is legit but futile.

There are two (probably more) good sectors of sandbars in that stretch. I occasionally surf up there but it’s solely a “I gotta spot to park” situation.

Money took over the northern Outer banks decades ago...bob knows that but obviously it did not stop his actions...
