    thats BS. This is part of surfing, having to deal with less experienced surfers in the water, and realizing that boards can get damaged.

    I can't believe the court made the less experienced surfer pay $750.

    wow why would you take it to court in the first place? To pay a lawyer must be far greater than the $750 repair

    Way to kill the sport. That's the kind of stuff that bans surfing in certain places. It could ruin it for everybody else. :confused:

    wow pretty gay for that to go to court. if someone gets next to me in lineup im gonna have a pen and paper in ziplock for them to sign waiver. BTW I have liabilty policies for sale for surf accidents.......lmao

    when i let my friend that is either trying to surf or never really surf that much or just someone in the lineup who is thinking bout buying that kind of board try one of my boards i make sure they agree that any damage they do it will be their responsibilty to get it fixed and they pay for it. now grant it i only let my friends that dont surf all the time try my merrick and my 7'6 i never let them touch my new high performance shortboard.

    would you rather them go to small claims court, or fight it out on the beach like they do around here in the states. I mean, it sounds like this is a pretty small town on the coast of NS, and since these two guys will probably be seeing each other every day for the rest of their lives, you gotta handle it somehow right? So, the canadians once again show us that they use restraint, rather than force. Something us angry americans could learn from. Personally, I am on the fighting side of things, but only if people are si**s about it.

    My best friend had this happen to him over the summer at blacks. Why did this other guy immediately take him to Southcoast in PB and purchase my friend a brand new $750 merrick... I was happy for him, but pissed. When some brazillian fu** broke my board in half a couple years ago dropping in on me, it resulted in a fist fight on the beach, and even after that, there was a language barrier, so the guy was acting like he didnt know what my problem was...

    I guess some people are lucky, some arent. I just must look like a di** or something. I mean, people are generally unfriendly to me in the water, unless at my local breaks. My other friends are out shooting the sh** with every tool in the lineup, meanwhile, I get cold stares as I paddle by.... Strange world.

    just called geico and got 'collision insurance' for my surfboard.
    they will send me an insurance card in the mail.
    guy who sued him must have a lot of free time.

    This stuff should NEVER go to court. Whats next - personal injury suits - contributory negligence ???? We don't need this BULLSH*! out on the water. On the other hand - a fist fight can get you into a real lawsuit or locked up. I have a good friend who's been in jail now for the last 2 years with ALOT more to do. What did he do ? Got into a fist fight at football game when some A-hole would not leave his wife alone. The other guy got hit, fell, & hit his head on a step. He's now paralyzed. My friend never had as much as a parking ticket. His life was changed in seconds. The only advice I can give is to THINK before doing something stupid. It can change your life.

    dude that sucks. i gotta say fighting shouldnt be needed, all you gotta do is just tell the guy watch out and let him throw the first punch. like this past summer when a kook dropped in on me and sliced my rail on my merrick at first i was pissed off but then i asked to go talk to his parents and his parents didnt want revenge on the kid so they payed for the whole repair for it. and everything is aight between me and him even though im no longer surf next to him. but out of the whole thing i got a new board.

    The same thing happened to me about 4 or 5 years ago when I was 11. I was more unknowledgable than I am now about surf etiquette when paddling out, and this 50 year-old dude was charging down the line. I was in his way and he put a major gash in the rail of my board.

    Luckily, I wasn't taken to court or anything, because at that moment I was scared sh1tless! Instead, the dude just cursed me off for the next 10 minutes while he was paddling back out right on my hip. I got the guilt ticket and I almost cried (keep in mind I was 11).

    Even though I was the one at fault, the guy apologized for cursing me off later on in the day. Nonetheless, I was shameful and didn't surf confidently for probably a week or two.

    Point of the story-glad I didn't go to court to pay for his board damages like what happened in NS.

    That's utter b.s. that the defendant had to pay. Now there's a precedent that will be cited by other people in similar situations. Are you riding a junker board and want a shiny new one? Just run over kooks dropping in on you and take them to court!

    It is crazy. Word is that the guy who took the kook to court is a hot shot lawyer, and is obviously why he represented himself.

    The thing that boggles my mind is why with all his "experiance" didn't he see the kook and ride below/above him? or get off the wave entirely.

    yeah, as a beginner, we all learn our lesson by getting screamed on at a young age. its how you learn. But one thing I won't tolerate, is some A-hole who thinks he is a professional aiming at you and stuff. I will get pissed off and start something over that. When some tool has tons of wave face to work with, yet still get close enough to slash right in front of you.... It's like, I have had to pop out of, i dunno, 2000 waves in my life just beacuse some idiot is in my way... I NEVER go at people... Yeah, sometimes, if i can get a clean turn by you I might spray you, playfully, but ifs its DOH and some guy aims at me, I will go off on him. But I also take mine like a man and take the whitewater and closeout on the head and I always get out of the way...

    But anyway, we have all been there, if you think some 4 foot sloppy shooulder is worth ruining your own board and someone else's session, you aare a kook. I mean, every respoinsible surfer gets out of the way, and they will pop off the back of the wave if some beginner is in the way.

    I mean, it takes me litterally missing a huge barrel or something for me to even look at you funny. All summer, I just take one last cut back and stop the ride. its not worth it... And to the guys who run begginers off waves and stuff... your lame too! The classiest pro guys I know are gentleman in the water for the most part. Role models for kids and all that
