    I think the municipality blundered in having public beaches without public access. Up here (in MA), as previously stated, there are shore front private properties, with signage stating at what point the private property ends with regard to tide, etc. There are also many public access points as well as public beach sections. And it seems that most people don't care if you walk on "their" beach, just be respectful.

    It seems that in Duck, the genie is out of the bottle, but the town could have required the developers to have public access points at the edges or at spots within the developments (say during the permitting process), or the town aquired and created access zones.

    The people have a right to dictate access to their private property, even though it may not be "cool" or "neighborly". It is a slippery slope when we jettison "the rule of law", which is in place to protect rights and freedoms, for a mob rule mentality. There is due process in place, and IMHO, that should be utilized before resorting to extreme measures. Perhaps via vote, the town could purchase back some access via eminent domain or some other mechanism.
    Disclaimer: I have limited knowledge of legal matters ..

    100%!!! If they have created a private beach club then the same should pay for any beach replenishment not any taxpayer dollars.

    I still say we duct tape her to a pole, cover her with sugar, and place her on top of a fire ant mound. Just sayin......
    It has nothing to do with beach access or that she's rich. Watch the video. She NEEDS to have this done to her.

    Yes - the successful establishment of perpetual public access here works if the easement is accessible from public property (a road, sidewalk, boat ramp, etc.). Then you need lots of stakeholders to show up at public meetings, hopefully with old photos, news clips etc to provide strong documentation to the doucebags in charge, to enforce the 20 year public access grandfather clause. Only if enough prominent community members show up will it have a chance.

    That's why it's important, especially for us, to document free access now, for future battles.

    I’ve already told the story of an area here with sometimes perfect surf with literally zero access which is owned by a combination of private ownership, state ownership and Indian reservations.

    In one of the most liberal states in the Union, they continue to kick the can down the road...as opposed to the platform that they usually preach.

    Meanwhile, surfers continue to find ways in.

    This isn’t about a political platform or stance. It’s just about access, and it appears that neither political party has cornered the market on this particular issue.

    I believe that this thread should follow that lead.

    Yankee I wasn't trying to take a stab at your success, please don't misconstrue any of my comments towards the rich as knocks at you. From what I've gathered online these people are not simply renting or blue collar leftovers from a bygone era. And man, for someone who slings a lot of shit around here you can't take a razzle, at all lol. My surf simply comment was a bit of a jab but seriously, and this comment is certainly not out of enyy, it's not withing everyone's means to do that. And it goes beyond that, this is about humans being able to access a natural resource. I'm honestly sad man, that visit in AI was fun, we dog bonded, but obviously I don't think that would be the case anymore.

    Duder I really give zero fucks where you go to surf. And I'm honestly quite content with what I have and where I am. I actually haven't ridden a wave in over a year and I really don't even give a shit about that either, the ocean will be there when I return, and I'll get mine when I paddle back out. Always do.

    You've evolved from law of the sea to rule of law. Remember always this shit is based in outlaw culture, so driveling on and on about rule of law will get you so far.

    The only real personal beef I have with you is you go on and on about the human virus, claim to care about public land conservation and biodiversity, but every other thing you spout is antithetical to that.

    Well, you brought up where I surf. Not me. So you obviously do seem to care where I surf. Odd, and had nothing to do with this treade, but you’re entitled to your opinion.

    And you are wrong. I am consistently AGAINST this administration’s stance towards the environment. Yet, I consistently support what are considered Conservative platforms regarding the economy, illegal immigration, trade tariffs & the American Constitutional right to due process.

    You have unfortunately lumped me into some sort of imaginary groupthink entity of your own devisement.

    The “driveling” emanates from you, “amigo.”

    I’m calm & collected. Responding with Rule of Law rationale. You’re the one who’s going into anger mode, just look at you: saying we cannot be pals because you disagree with me, that I can’t take shit (why would you personalize your attacks to give me shit, then?), saying you’re sad, it goes on & on with you on a very personal level.

    That’s your problem, fella. You don’t seem capable of having a discussion with anyone who has a differing viewpoint from yours.

    It’s just talkin’ so you may want to work on not taking everything to the angry man level. And do kindly stop inventing narratives regarding my life.

    Yeah man I'm just gonna leave it at that. Funny thing is there are several people I hold near and dear who have drastically differing opinions than mine and we sit down and eat peacefully quite regularly.
