Yeah Raddad, that's easier said than done. Working solo/independent is tough. Getting what's owed to you and maintaining a good reputation are not always compatible.

But hey, it's like my Pop says... 'you might not be able to make them pay YOU, but you can still make them pay.'

Good on you Fitz for not airing out the dirty laundry. Unfortunately in NY you don't need a good reputation/community to maintain a shop presence. Sell enough expensive clothes or latte's, and you're good to go....

You wont get a bad rep for collecting $$$ when it is rightfully owed to you . The shaper needs to go in there and make his presents felt no violence , just stand there and stare at the mfer in his public shop until it is packed . Than simple ask where is my $$$$$ for all my boards. If that doesnt work than Call the BARR association and the will give you the # of a Lawyer that will work PROBONO , to write a juicey letter, Threatening Theft of serviceses/ merchandise. Theres ways to get paid brutha work it out , I deal with this sh!t all the time , people can control their wants and over order beyond their budgets all the time and I have to do this battle , or put a lein on their home. Its tough and I fell for the dude, but ignoring it just puts it in the past.

Shaper should absolutely NOT argue his case through social media to avoid libel counter claim by shop owner. Shaper should research legal entity of shop incorporation including all owners to be named as co defendants for breach of contract in District Court. He can obtain the filing document from clerk of the court, filing fee's usually run less than $250 and use local sheriff's office to serve the writ as much cheaper over special process sever fee's. Depending on "treatment" by local courts most judge's do recognize verbal contracts. The action might force the complaint by shaper for the shop to pay up to avoid either default or summary judgement.

Do you think the shop has a habit of not honoring these business agreements? If the shop is in Maryland drop me a PM I'll send you the link to search for prior courts cases deposed by District/Circuit court system that should be used against the shop establishing a default whether verbal or contractual track record in the eyes of the court.

Hi Goofy footer, thanks for the great reply! the shop is in ny and the shaper is in the mid atlantic area. He has started the legal process against the shop. And great points about not getting into a social media battle. I hope he gets paid for his hard work.

Its a lose-lose situation in my mind...shop won't pay and when forced to do so they then will stop doing business with the shaper; dog the shaper to other shops, etc. Shaper has to pay $250 or so for filing and deal with run around until shop finally pays...he's out more money until he eventually gets some justice. Pretty lame for the shaper...bad situation all around...
